Operatives of the Nigerian Department of State Service, DSS have supposedly captured and kept a man, Anthony Okolie for acquiring a sim card that was recently used by Hannan, a daughter l of Nigeria President Muhammadu Buhari.
Okolie disclosed to The Guardian on Monday that he purchased the MTN cell phone sim card in 2018, two years preceding his capture.
He was captured on Monday, July 22 at Nnedisi Road, Asaba, Delta State.
Okolie was taken to Abuja by the DSS agents and was kept in guardianship until his discharge in December 2019.
Endeavors to get DSS response to the charge demonstrated fruitless as telephone calls and an instant message to its representative Peter Afunanya were not promptly reacted to.
Portraying Okolie’s difficulty, his legal counselor Tope Akinyode said Okolie was confined for more than 15 weeks by agents of the Nigerian mystery police. Akinyode placed that “the sim card got excess and was reused to the market available to be purchased (after Hanan stopped using it).”
“Okolie lawfully bought the sim card after years of redundancy unknown to him who the previous owner was,” Akinyode claimed.
Akinyode said Okolie’s confinement was unlawful in light of the fact that he has the receipt for the acquisition of the sim card and every other report relating to the sim card.
Okolie’s legal counselor revealed to The Guardian that in attempting to get his customer captured, the DSS checked his phone discussion and at first captured an old individual who has an association with him until they later discovered Okolie.
“To begin with, every one of the laws have settled that capture as a substitute is prohibited and unlawful in Nigeria,” Akinyode stated, “Additionally, the capture of the unfortunate casualty over a property which he legitimately acquired is incredibly illicit similarly as the long detainment without preliminary adds up to unlawful confinement.”
His case is upheld by Nigerian law. By goodness of the arrangements of segment 35(5) of the 1999 Constitution (as corrected), segment 483 of the criminal methodology Act and segment 42 of the criminal system Code, the police should not to keep any individual for over 24 hours without a warrant from a justice.
Akinyode revealed that Okolie will continue to court to document a claim against the DSS and Ms Hanan Buhari, requesting remuneration for the rupture of his principal human rights.
“We are looking for legitimate change on the issue,” Akinyode disclosed to The Guardian. “His (Okolie) detainment for 10 weeks is unlawful and we won’t acknowledge such.”
